Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Lingard applications for iPhone, iPad, Mac, and Android, the website, and related services (collectively, the "Service"). By using Lingard, you agree to these Terms. If you do not agree, do not use the Service.
THE SERVICE
Lingard is a language-learning and reading service that may include features such as reading tools, vocabulary and card management, translation, text-to-speech, speech recognition, AI-assisted features, reminders, profile synchronization, media import, and subscription-based premium access. Features may differ between iPhone, iPad, Mac, and Android, and may also vary by language, region, operating system, storefront, and account type.
ELIGIBILITY AND ACCOUNTS
You must be legally able to accept these Terms in your jurisdiction. If you use Lingard on behalf of an organization, you represent that you have authority to bind that organization.
Some parts of Lingard may work through an anonymous or automatically created account identifier before you sign in explicitly. Lingard may also allow sign-in or account linking through email/password and supported third-party identity providers. You are responsible for keeping your account credentials secure and for activity that occurs under your account.
You agree to provide accurate information when you create or update an account and to keep that information reasonably current.
SUBSCRIPTIONS, TRIALS, AND PURCHASES
Certain features of Lingard require a paid plan. Available plans may vary by app platform, web checkout, storefront, country, and promotion.
On Apple platforms, including iPhone, iPad, and Mac, and on Android, Lingard may offer recurring subscriptions such as weekly, monthly, 3-month, and yearly plans, including promotional or introductory offers. On the website, Lingard may offer paid plans through Stripe Managed Payments and Link/Sold Through Link. Not every plan is available to every user at all times.
Payments are billed by the payment provider used for the purchase, not directly by Lingard. App purchases are billed by the Apple App Store or Google Play. Web purchases are processed through Stripe Managed Payments and Link/Sold Through Link, where Stripe or its affiliate acts as merchant of record for eligible digital-product transactions. By purchasing a paid plan, you authorize the applicable provider to charge your selected payment method under that provider's terms and policies, including applicable taxes.
Recurring subscriptions renew automatically unless cancelled before the renewal date through the relevant Apple, Google, Stripe/Link, or other payment account or support flow. Web subscription management may require a Link account and may be available through Link.com, Stripe/Link support, or the account tools shown during checkout or in receipts. If a free trial or introductory offer is provided for an eligible plan, it will convert to a paid subscription unless you cancel before the trial or offer period ends.
Deleting or uninstalling the app, deleting a Lingard account, or stopping use of the website does not by itself cancel a subscription unless the applicable payment provider's account-deletion flow says otherwise. Pricing, taxes, billing cycles, eligibility for offers, currency conversion, and availability are determined by the applicable payment provider and may change from time to time. Refunds, credits, chargebacks, and billing disputes are handled according to the policies of Apple, Google, Stripe/Link/Sold Through Link, or another relevant payment provider, the Lingard Refund Policy, and applicable law. Lingard may provide restore-purchase functionality where supported, but entitlement availability ultimately depends on valid store or payment-provider records.
For web purchases, Stripe/Link may provide receipts, transaction-level customer support, dispute handling, tax compliance, refund workflows, and subscription management. Lingard remains responsible for operating the Service and helping with product access issues; if paid access does not appear in your Lingard account after a valid purchase, contact us at hello@lingard.app.
USER CONTENT
You retain ownership of content you submit or create in Lingard, such as imported texts, cards, notes, images, profile details, and other materials. You represent that you have the rights needed to upload or use that content and that doing so does not violate applicable law or third-party rights.
You grant Lingard a limited, non-exclusive license to host, process, store, reproduce, and transmit your content only as necessary to operate, secure, improve, and support the Service.
ACCEPTABLE USE
You agree not to:
- use Lingard in violation of law, regulation, or third-party rights;
- upload malicious code, interfere with the Service, or attempt unauthorized access to systems, accounts, or data;
- harvest data, scrape the Service in an abusive way, or use automated means that materially burden the Service without authorization;
- misuse subscriptions, trials, attribution systems, referral links, or payment flows;
- upload or share content you do not have the right to use.
THIRD-PARTY SERVICES AND CONTENT
Lingard may rely on or link to third-party services, storefronts, payment providers, APIs, websites, and content providers. We are not responsible for third-party products or services, and your use of them is subject to their own terms and policies, including the Stripe Consumer Terms and Stripe Privacy Policy where applicable to web purchases.
CONNECTED AI ASSISTANTS
If you choose to connect Lingard to a third-party AI assistant or connector, such as ChatGPT, Codex, Claude, Gemini, or similar services, that assistant may read or update the parts of your Lingard account that you request and authorize through the available scopes. You are responsible for reviewing assistant-generated content and for the actions you ask a connected assistant to perform in your Lingard account.
Connected assistants are provided by third parties and are subject to their own terms and policies. Lingard does not control third-party assistant output. You can disconnect a connector where supported or contact us for help with access or deletion requests.
AVAILABILITY, SYNC, AND CHANGES
We may update, improve, suspend, restrict, or discontinue any part of Lingard at any time. We do not guarantee that every feature, synchronization function, AI capability, translation result, media source, or cloud integration will be available at all times or on every device.
Cloud sync and account-linked features may depend on third-party cloud, store, and platform infrastructure. Delays, outages, or data inconsistencies may occur.
INTELLECTUAL PROPERTY
Lingard, including its software, design, branding, text, graphics, interfaces, and other content provided by us, is protected by intellectual property laws and remains the property of Lingard and its licensors. These Terms do not transfer ownership to you. Except as permitted by law, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service without prior written permission.
DISCLAIMERS
Lingard is provided on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by law. We do not guarantee uninterrupted operation, error-free functionality, perfect translations, accurate AI-generated output, or that the Service will meet every learning or business need. Lingard is an educational product and is not a substitute for professional, legal, medical, or financial advice.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Lingard and its affiliates, licensors, partners, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Service. If applicable law does not allow certain limitations, some of these limitations may not apply to you.
TERMINATION
We may suspend or terminate your access to Lingard if we believe you have violated these Terms, created risk for the Service or other users, or where suspension is required for legal, security, or operational reasons. You may stop using Lingard at any time. Sections that by their nature should survive termination will survive termination.
GOVERNING LAW
To the extent permitted by applicable law, these Terms are governed by the laws of Poland, without regard to conflict-of-law principles.
CHANGES TO THESE TERMS
We may revise these Terms from time to time. If we make a material change, we may update the date below and, where appropriate, provide additional notice through the app or website. By continuing to use Lingard after updated Terms become effective, you agree to the revised Terms.
